Reportable Conduct Scheme

The reportable conduct scheme commenced on 1 July 2017 and has been introduced to improve oversight of how organisations prevent and respond to allegations of child abuse. The scheme requires centralised reporting to the Commission for Children and Young People of allegations of child abuse made against workers or volunteers in relevant services with a high level of responsibility for children and young people, such as out of home care services.

 

Key points:

- Administered by the Commission for Children and Young People and Community Service Organisations (agencies) must advise the Commission within 3 working days of becoming aware of a reportable allegation.
- The RCS has been designed to ensure that the Commission are aware of any allegation of major impact re employee and volunteers or carers misconduct. It is to improve how organisations prevent and respond to allegations of child abuse.

- Reportable Allegations involve: Sexual offences or misconduct, Physical Violence, Behaviour that causes Emotional or Psychological Harm to a child

- The Commission acts as an independent body and may at times conduct investigations, as well as scrutinise and audit systems and processes for handling allegations

- The Commission may also share information where appropriate, including with the Department of Justice and Regulation’s Working with Children Check Unit, Education Department, other relevant regulators and Victoria Police, to better prevent and protect children from abuse

- Enables the Commission to independently oversee the responses and build skills and knowledge within organisations to better manage allegations of suspected child abuse.

- They are also able to monitor and report to Parliament on the performance of the scheme and trends.

- It does not replace or interfere with police investigations and they work with Victoria Police to make sure allegations of criminal conduct are dealt with appropriately
